- 1.2 By accessing or using our website, mobile apps, or services, you agree to be bound by these Terms. Please read them carefully before placing an order or engaging with our platform.
- 1.3 We reserve the right to update these Terms at any time by posting the revised version on our website. Your continued use of our services after any such changes indicates your acceptance of the new Terms.
- Products and Services
- 2.1 AirDataLink offers a range of digital products, including eSIMs and data plans, for use on mobile devices while traveling internationally. Product descriptions are provided in good faith and are believed to be accurate at the time of publishing.
- 2.2 As a reseller, we rely on third-party telecommunications providers for network performance and data speeds. These factors are beyond our direct control and may vary by location and provider. We do not guarantee uninterrupted service, preferred network options or specific data speeds.
- 2.3 In the event of a service outage due to network maintenance, upgrades, or technical issues, we will make reasonable efforts to inform you and provide an estimated timeline for service restoration, based on information from our providers.
- 2.4 We reserve the right to modify, suspend, or discontinue any product or service at any time without prior notice, subject to our agreements with service providers.
- Ordering and Payment
- 3.1 By placing an order through our website or mobile app, you represent that all information provided, including billing and shipping details, is accurate, complete, and up-to-date. You also confirm that you are authorized to use the selected payment method.
- 3.2 We reserve the right to refuse, cancel, or limit orders at our sole discretion, particularly in cases of suspected fraud, unauthorized access, or illegal activity.
- 3.3 Prices are listed in Malaysian Ringgit (MYR), United States Dollars (USD), and other currencies for comparison. All payments are processed in Malaysian Ringgit (MYR).
- 3.4 We accept payment via credit card, debit card, ewallets and other methods as indicated on our website during checkout. All transactions are securely processed through our trusted payment gateways and are subject to their respective terms of service.
- 3.5 By completing a payment, you authorize AirDataLink to charge the full amount to your selected payment method. If your payment is declined or fails for any reason, your order may be automatically cancelled, and we reserve the right to attempt collection through alternate means.
- Delivery and Shipping
- 4.1 Digital products, such as eSIMs and data plans, will be delivered electronically and within the hour during normal operation hours upon successful payment verification. In some cases, it may take 24 hours especially if delivery is outside of normal operation hours. Access instructions and activation codes will be sent to the email address provided during checkout. You are required to provide the correct email address in order to receive the delivery.
- 4.2 It is your responsibility to ensure that your device is compatible with the digital product purchased and that you follow the provided activation instructions carefully. AirDataLink is not liable for any issues arising from user error or device incompatibility.
- Returns and Refunds
- 5.1 Our refund policy is governed by the separate Return and Refund Policy document, which is incorporated by reference into these Terms and Conditions.
- 5.2 You acknowledge that due to the nature of digital products and services, refunds are not given once the product has been delivered and any refunds are limited to specific circumstances as outlined in our Return and Refund Policy.
- 5.3 We reserve the right to refuse refunds, offer partial refunds, or provide service credits at our discretion, in accordance with our Return and Refund Policy.
- 5.4 Any approved refund may be subject to an administrative fee along with any applicable fee by the provider.

- 6.1 You agree to use the services in compliance with all applicable laws and regulations in your home country and any country where you use our services.
- 6.2 You must not use the services for any unlawful or prohibited purpose, including but not limited to spam, hacking, or transmission of malicious software.
- 6.3 The service provider reserves the right to suspend or terminate the service if it is reasonably believed you are using it in violation of these Terms or in a manner that may cause harm to the network, other users, or our business reputation.

- c. When reporting an issue, please include your Order Number and ICCID to help us quickly identify your account and provide efficient assistance.
- d. Our support team will make every effort to respond to your inquiry and resolve the issue in a timely manner.
- e. Please note that some issues may require investigation with our service providers, which may extend the resolution time.
- Intellectual Property
- 7.1 All content, trademarks, logos, and branding elements displayed on the AirDataLink website and mobile apps are the exclusive property of SimplyGlobe Resources or our licensors and are protected by international copyright and trademark laws.
- 7.2 You may not reproduce, modify, distribute, transmit, display, publish, or create derivative works from any of our intellectual property without our prior written consent. Unauthorized use of our intellectual property may result in legal action and the termination of your access to our services.
- 7.3 If you believe that any content on our platform infringes upon your intellectual property rights, please contact us immediately with detailed evidence of the alleged infringement. We will promptly investigate and take appropriate action under applicable laws.
- Limitation of Liability
- 8.1 To the fullest extent permitted by law, AirDataLink’s total liability for any claims, damages, or losses shall be limited to the amount paid for the specific product or service in dispute.
- 8.2 We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our platform or products.
- 8.3 We make no warranties regarding the accuracy, reliability, completeness, or timeliness of information provided. Your use of our platform and services is at your own risk.
- 8.4 We are not responsible for damages arising from the acts or omissions of third-party providers, including but not limited to network outages, coverage issues, or quality of service problems.
- 8.5 You agree that we shall not be liable for any loss or damage resulting from:
- a. Your failure to comply with these Terms
- b. Any unauthorized access to or use of our servers and/or any personal information stored therein
- c. Any interruption or cessation of transmission to or from our services
- d. Any bugs, viruses, trojan horses, or the like which may be transmitted to or through our service by any third party
- Governing Law and Dispute Resolution
- 9.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
- 9.2 In the event of any dispute, controversy, or claim arising out of or relating to the Services, including the interpretation, validity, or breach of these Terms of Service, you agree to submit to the exclusive jurisdiction of the courts of Malaysia.

- 9.5 You agree to indemnify, defend, and hold harmless SimplyGlobe Resources, its management, officers, directors, employees and related parties from and against any and all claims, demands, losses, liabilities, and expenses (including legal fees) that may arise out of or in connection with your breach, contravention, or non-compliance with any provision of these Terms of Service.
- 9.6 By agreeing to these Terms, you waive your right to participate in any class action lawsuits or class-wide arbitration proceedings against SimplyGlobe Resources or its affiliates. You agree that any legal action must be brought on an individual basis only.
- Severability and Waiver
- 10.1 If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect to the fullest extent permitted by law.

- 12.1 These Terms and Conditions, together with our Privacy Policy and any additional terms or policies referenced herein, constitute the entire agreement between you and SimplyGlobe Resources regarding your use of our website, mobile apps, products, and services.
